Making an Offer to Purchase a Property

Buyer beware: Before you agree terms then sign and exchange contracts you should find out about the property; in this respect, the seller does not have to tell you about problems with the property, neighbourhood and land even though the seller should be truthfull when answering any questions
Title Check: Ensuring seller's ownership of the property and thus legallity to sell
Neighbourhood Planning: Consulting local authorities about planned works such as roadworks, property developments etc that may negativelly (or positively) impact the property
Mine Workings: Additional searches may be required to discover subterranean mine workings in mining areas
Mortgage Offers
Home loans: If the buyer requires a mortgage to purchase the property then a formal mortgage offer from the chosen lending company - the maximum mortgage sum available will depend on a valuation survey
Property Valuation Survey
Mortgage lenders need to ensure they will be able to recoup their loan if anything goes wrong and thus require a minimum valuation survey and will use this to calculate maximum loan values
Structural Survey
Property Inspection: It is always prudent to have an independant property survey to help minimise purchase risk and ensure there are no hidden repair costs associated with the purchase: Subsidence, dry rot, corroded wall ties, collapsed drains, out of date wiring are just a few of the potential problems that may not be found in valuation surveys and can require several thousand pounds to rectify
Property Insurance
Minimising risk: Once deposits are paid, contracts are agreed and exchanged then the new owner will become responsible for the property and should ensure appropriate insurance is in place
Exchange of Contracts
Paying Deposits: Once contracts are exchanged the purchase-sale is legally binding and neither party can withdraw without paying compensation to the other party; buyers usually pay a 10% deposit at this time
After Exchanging Contracts
Land Registry: Before completion, a few other elements will need to be finalised such as: mortgage documents to ensure funds are transferred on behalf of the seller, transfer of ownership, land registry checks
Agreed Conditions: Buyers may purchase on the condition that certain repairs have been carried out and these will be confirmed prior to completion, a fixtures and fittings list may also be checked and confirmed
Completion
Funds Transfer: Once all post exchange tasks are confirmed a completion date will be agreed for the transfer of the remaining funds from buyer/mortgage lender to seller
Property Ownership: On the completion date keys will be handed over to the new owner and legal documents proving ownership will be released
After Completion
Stamp Duty: The new owner's details will be submitted to the Land Registry and and any Stamp Duty or Land Tax will need to be paid
